Posted Workers in Romania

If you are posted in Romania, you must obtain the long-stay visa for posting (type D/DT) and, after entering Romania, the residence permit for posting from the General Inspectorate for Immigration. Since GEO 32/2026 there is no longer a separate work permit (aviz de detasare) for posted workers.

The long-term visa for employees who are detached to Romania is a type D one for which a residence permit for Romania is also issued by the authorities. The foreign national who works in the country will carry this document with him/her and will need to apply for it with the General Inspectorate for Immigration. The long-stay visa for posting is granted, upon request, by the Romanian Embassies or Consulates in the country where you have your residence or domicile, if you are seconded by an employer established in an EU/EEA Member State or in Switzerland, whose residence permit you hold, or as an intra-corporate transferee by a company of the same group:

• at a representation, branch or branch located in the territory of Romania,

• to a commercial company, a Romanian legal person, whose associate / shareholder is the foreign company, with the same object of activity

or if you are seconded by an employer based in an EU/EEA Member State or Switzerland to a legal entity from Romania, based on a commercial service contract concluded between the two parties.

Also, if you come from a country with which Romania has signed a bilateral agreement on access to the labor market, the conditions of entry and stay are those set out in that agreement; within 5 days of your entry, the employer or the beneficiary of the services must communicate your name in writing to the competent territorial unit of the General Inspectorate for Immigration.

The long-stay visa for posting (D/DT) may also be granted to foreigners in the following categories:

– foreigners carrying out teaching, scientific or other specific activities of a temporary nature in institutions accredited or provisionally authorized in Romania, on the basis of bilateral agreements or as holders of a right of residence for carrying out scientific research activities; and the specially qualified personnel, on the basis of the order of the Minister of National Education, as well as the foreigners who perform artistic activities in cultural institutions in Romania, based on the Order of the Minister of Culture;

– foreigners who are to carry on the territory of Romania temporary activities requested by ministries or other central or local public administration authorities or by autonomous administrative authorities.

If you are seconded to Romania, the residence visa is of type D / DT.

The posting gives you the right to work in Romania for 12 months, extendable to a maximum of 18 months in any 36-month period (intra-corporate transferees: up to 3 years for managers and specialists, 1 year for trainees), based on the decision of posting from the foreign employer to a legal entity from Romania or to a representation or branch in Romania of a legal person based abroad.

For the long-stay visa for posting you must submit the residence permit issued by the state of your employer, the employment contract and the posting act (translated and legalised), proof of means of subsistence at the level of the national minimum gross wage, a criminal record certificate and travel medical insurance valid in all Schengen states with a minimum cover of EUR 30,000. Intra-corporate transferees (ICT) must in addition prove the group link between the Romanian host and the sending company, a posting act stating the duration, position and salary of the transfer, and prior employment in the group of at least 6 months (managers and specialists) or 3 months (trainees). The beneficiary of the services in Romania no longer files a separate application for a posting notice (aviz de detasare): the opinion of the General Inspectorate for Immigration is requested by the Ministry of Foreign Affairs during the visa procedure and is issued within 30 days, extendable by 15 days.

Separately, under the law on transnational posting (Law 16/2017 and its norms), the employer established in the EU/EEA/Switzerland that posts you sends to the Territorial Labor Inspectorate (ITM) in whose territorial area the activity will take place a declaration in Romanian regarding the posting, at the latest before you start work in Romania; any modification of the declared elements must be notified to the ITM at the latest on the day it occurs, and the posting documents must be kept available for 3 years after the end of the posting.

In order to obtain the residence permit, you must contact the territorial formations of the General Inspectorate for Immigration (IGI) in the county where you live at least 30 days before the expiration of the residence permit granted by the visa and personally submit a series of documents: application, border crossing document ( original passport, travel document, etc.) and copy, which must also contain the long-stay visa for posting (D / DT), copy of the posting document; the employment contract registered in the state of your employer (translated and legalised), the residence permit issued by that state, the proof of the means of maintenance at least at the level of the national minimum gross wage, the proof of the legal possession of the living space (original and copy), the social health insurance, medical certificate, taxes.

After the expiry of the posting period, the employer to which you were posted may hire you as a permanent worker only by filing a single application on the WorkinRomania.gov.ro platform, under the conditions of GEO 32/2026; no separate work authorization is issued any more.

The right of residence for posting can be extended for the period of the posting (maximum 18 months in any 36-month period; up to 3 years for ICT managers and specialists), and if the employer wishes to keep you afterwards, it must file a single application for employment on the WorkinRomania.gov.ro platform, so that you obtain the single permit (residence and work).

The work authorization no longer exists; the right of residence for posting ceases at the end of the period for which you were posted in Romania.

Foreign nationals who were detached to Romania, hold a long-term residence right and have been living legally in the country for at least eight years can consider their option to apply for citizenship.
